In
the
event

things
going
horribly
wrong
will

is better to persuade
your debtor to come
to an agreement
with you before
it becomes necessay
to go to court.
That is where the
small claims debt
service can be most
effective as a third
party.
If
I
lose
will
I
have
to
pay
costs
to
the
other
side?
The
District Judge has
the option to award
travel expenses,
loss of earnings
and interest to
the other side.
If the other side
have legal representation
the judge will decide
just how essential
this was before
making
a costs decision.
However, if the
Claimant ( the person
bringing the claim
against the debtor)
brings an unsubstantiated
claim to the court
or is proved to
be telling lies,
or misrepresents
the facts the judge
may indeed frown
on
such behaviour and
could award all
costs to the other
side. Make sure
you have evidence
to back up
your claim.

I
make
a

in
England
&
Wales?
Yes,
but only if the
Defendant (person
you wish to claim
against) resides
in England or Wales.
