Will small-claims-debt be making any additional charges above those published on this web site?
 

There is an up to date list of current court fees charged at our fee-costs page including a live example
illustrating the fact that all your court costs are refundable when you win your case.The district judges
will usaually award costs. Our own initail Hard legal letter fee will always be refunded against our very
reasonable commision. Remember our email legal letter is always sent free of charge.


Please take note that depending on the progress of your claim there may be additional court fees to
pay before the allocation of a court hearing or for enforcing judgments. .

Will we always have the same consultant?
 
Yes. Our consultants have a limited portfolio of clients in order that they may concentrate on our clients'
needs on an individual basis.

Can small-claims-debt advise us on existing legal issues?
 
Please note that we do not offer specific legal advice. It may be appropriate to refer you to a specialist
solicitor. However, we can provide procedural advice particularly if you already have a judgment and
require enforcement or are awaiting a hearing and need to know how to conduct the court procedures.

In the event of things going horribly wrong will you assist with our negotiations with the court or the other side?
 
Yes. In all cases it is better to persuade your debtor to come to an agreement with you before it becomes necessay to go to court. That is where the small claims debt service can be most effective as a third party.
If I lose will I have to pay costs to the other side?
 
The District Judge has the option to award travel expenses, loss of earnings and interest to the other side.
If the other side have legal representation the judge will decide just how essential this was before making
a costs decision.


However, if the Claimant ( the person bringing the claim against the debtor) brings an unsubstantiated
claim to the court or is proved to be telling lies, or misrepresents the facts the judge may indeed frown on
such behaviour and could award all costs to the other side. Make sure you have evidence to back up
your claim.


I live abroad. Can I make a claim in England & Wales?
 
Yes, but only if the Defendant (person you wish to claim against) resides in England or Wales.
